Land Use law
For more than five decades, Murray Plumb & Murray has advised clients on land use matters that have shaped the law on how property can be developed and protected in the State of Maine. Our attorneys are actively engaged in land use matters big and small, from representing clients before municipal boards to litigating cases of statewide significance that involve rights in real property.
Land use regulation and litigation are rarely straightforward. Determining which local, state and federal agencies have authority; what approvals are required; how local, state, and federal rules intersect and when it is necessary to turn to the courts to resolve a dispute requires seasoned judgment and practical experience.
This is where we can be uniquely helpful. We know the territory and have advised clients in every type of land use matter, representing clients who need assistance in obtaining a permit from a local or state agencies; providing guidance as to the scope of the rights they hold on the property they own; and serving as an advocate who can prosecute or defend their interests in litigation involving that property.
When it comes to permitting, we help clients proceed through all stages of the approval process. Whether it be a swimming pool or shopping center; single-family home or entire subdivision; private landing or public marina; ham radio antenna or regional telecommunications network; septic system or commercial gravel pit; we have helped build them all.
We regularly advise clients on what they can—and cannot—do with the properties given applicable local and state regulations; the language in their deeds; and the law that governs the use of real property.
When land use disputes arise, we provide steady and effective representation. Our attorneys work on behalf of clients in zoning and setback enforcement actions; permitting appeals; regulatory challenges; and litigation involving easements and boundaries. We take pride in helping our clients understand the disputes in which they are involved and achieving the best outcome given their interests and objectives.
